In this instruction we will talk about the following types of transportation:

1) international cargo transportation (there is a separate point about obtaining a license); 2) intra-republican cargo transportation.

1. General requirements for the implementation of activities

  1. Vehicle of the corresponding category

The vehicle does not have to be the property of a person. It can also be rented.

  1. Satisfactory financial condition of the organization or sole proprietor (not at the stage of liquidation, not at the stage of bankruptcy) and have property whose value is not less than:
  1. The employee appointed by the order responsible for the organization and performance of road transport with the appropriate level of qualification. If an individual entrepreneur will be engaged in urban or suburban transportation, he can also hire a person who will subsequently be appointed responsible for organizing and performing road transportation with the appropriate level of qualification, or he himself will meet these requirements and undergo the necessary training (if necessary).

The employee responsible for the organization and performance of road transport must have a higher or secondary specialized education, which includes the study of disciplines on transport activities in the field of road transport or undergo advanced training in an appropriate educational institution.

In the future, the person appointed responsible for the organization of road transport should improve their skills in this field at least once every five years.

  1. Drivers with appropriate qualifications

International cargo transportation

drivers who have a driver's license for the right to drive a motor vehicle of categories "B", "C" and (or) a composition of vehicles of categories "VE", "CE" as well as a medical certificate of health confirming fitness to drive motor vehicles.

International road transport of goods can be carried out on:

vehicles of categories "B" and "C", the permitted maximum weight of which does not exceed 7,500 kg, drivers at least 18 years old, with a total work experience as a driver of vehicles of category "B" and "C" for at least two years and having a certificate of professional competence,

on trains of vehicles of categories "BE", "CE" by drivers at least 21 years old with a total work experience as a driver of trains of vehicles of categories "BE", "CE" for at least two years, having a certificate of professional competence issued in accordance with the established procedure.

  1. Pre-trip control of the technical condition of vehicles

It can be carried out by a full-time employee (mechanic) or on the basis of a contract for the provision of paid services with the relevant organization. An individual entrepreneur can also carry out pre-trip control of the technical condition. These persons put a mark on the control measures in the waybill.

Only the driver of the direct vehicle cannot exercise such control.

*Since February 23, in connection with the entry of Decree No. 7 of November 23, 2017, the waybill can not be issued.

  1. Organization of pre-trip inspection of drivers

Pre-trip examination of the driver is carried out by a medical professional who has been trained in pre-trip medical examination. This medical worker can be a full-time employee of an organization or an employee of a healthcare organization engaged on a contractual basis.

In the absence of a full-time physician, it is necessary to conclude a contract for the provision of paid services with the relevant healthcare institution.

*Since February 23, due to the entry into force of Decree No. 7 of November 23, 2017, pre-trip inspection can be carried out without the involvement of doctors

  1. Travel permits on the territories of foreign states (for international transportation)

The permit to travel through the territory of a foreign state specifies the name of the automobile carrier, its legal address and telephone number, the number of the state registration of the bus, the route and the date of issue of this permit. This permit is certified by the signature and seal of the authority that issued it. Such permits used by Belarusian road carriers must be returned to the authority that issued them.

  1. Organization of the process of customs clearance of cargo (filling in and filing of customs declarations)
    Is carried out by the organization-the customs representative on the basis of the contract.

2. Licensing requirements for international road transport of goods

*A license is not required for intra-republican cargo transportation.

In order to obtain a license, it is necessary to prepare and submit a package of documents to the Transport Inspectorate of the Ministry of Transport and Communications at the place of registration of a legal entity or sole proprietor.

15 days from the date of submission of documents to the Transport Inspection of the entire package of documents. If it is necessary to conduct an examination of the conformity of the possibilities to carry out the licensed type of activity, the period is extended no more than 10 working days. The license is valid indefinitely.

Package of documents:

1. Order on the appointment of the person responsible for the implementation of road transport

2. A copy of the diploma of the relevant higher education or a copy of the certificate of retraining of the person appointed responsible for the implementation of road transport

3. List of vehicles on which this type of activity will be carried out

The list should reflect: the category, the brand of the car and its registration plate.

4. License application

5. Payment order for payment of state duty with the blue seal of the bank (state duty is 10 basic units)

Legal entities and sole proprietors with a location on the territory of medium-sized, small urban settlements, rural areas are exempt from paying this state duty if they have been operating for less than 7 (seven) years.

6. A power of attorney, if the documents for obtaining a license will not be submitted by the head of the organization or an individual entrepreneur, but by another authorized person

All documents must be placed in a cardboard folder-folder.

The Transport Inspectorate has no right to require additional documents from the applicant.

3. What is necessary to work with clients?

  1. License.
  2. Fulfill general requirements.
  3. A waybill for each flight.

  1. CMR-waybill is needed for international transportation, waybill (TN) - for intra-republican.
  2. Contract for the carriage of goods by road.
  3. Customs documents for goods (for international transportation).

4. Expedition activity

If the freight forwarder will carry out cargo transportation independently, it is necessary to familiarize yourself with all the requirements for cargo carriers described above. The freight forwarder has the right to involve the relevant carrier by concluding a contract with him for the carriage of goods by road (this is possible if the contract of the transport expedition allows this action).

Non-residents of the Republic of Belarus carry out forwarding activities on the territory of the Republic of Belarus (when importing goods), provided they open a representative office in the republic.

Freight forwarding activities for the export of goods are carried out by residents of the Republic of Belarus, as well as non-residents of the Republic of Belarus, whose founders (participants) are only Belarusian state legal entities, the Republic of Belarus or its administrative-territorial units.

Required documents

  1. Order-order (if the contract is concluded with an individual). Issued in triplicate.
  2. Assignment to the forwarder (it can be one-time, it can be within the framework of the contract)
  3. Client's power of attorney to the forwarder
  4. Forwarder's receipt (when accepting the cargo)
  5. Waybills for cargo (TN or TTN and CMR-waybill (for transportation abroad).
  6. Freight forwarding agreement
  7. Information about the conditions of carriage (issued by the client for specific goods).
  8. The contract of voluntary cargo insurance (in cases where it is provided for by the contract of the transport expedition). The freight forwarder enters into the contract.

Note:

When providing forwarding services related to international cargo transportation, the forms of forwarding documents (forwarding bill of lading, forwarding bill of lading, forwarder's receipt and others) recommended by international organizations in the field of forwarding activities can be used.
