1. Construction works and activities - list

It is necessary to decide which works can be considered construction, because this affects what documents you need.

Construction activity (construction) - activities for the construction, reconstruction, repair, restoration, improvement of an object, demolition, conservation of an unfinished object, including the implementation of organizational and technical measures, including the provision of engineering services in construction, preparation of permits and design documentation, construction, installation, commissioning.

This definition is normatively fixed in the legislation. But the ideal situation would be to have a table at hand in which a list of works that are construction would be given.

Fortunately, the list of works (and services) related to construction activities was approved by Resolution No. 17 of the Ministry of Architecture and Construction of the Republic of Belarus dated May 10, 2011.

As a general rule, the following documents may be required for the implementation of construction:

• certificate of conformity to construction works
• certificate of conformity to construction works
• qualification certificates for employees;
• occupational health and safety management system (in short - OSS);
• evaluation of the production control system (briefly - SEC) - is issued with a certificate of technical competence of the SEC;

2. Certificate of conformity for construction work

Mandatory certification of a certain list of works in construction is provided by the Technical Regulations of the Republic of Belarus "Buildings and structures, building materials and products. Security" (TR 2009/013/BY), which was approved by Resolution of the Council of Ministers of the Republic of Belarus No. 1748 dated 31.12.2009.

  7. Installation of outdoor networks and structures.
  8. Installation of precast concrete and reinforced concrete structures.
  9. Installation of steel structures.
  10. The device of anticorrosive coatings of building structures of structures.
  11. The device of road surfaces of pedestrian zones from paving slabs.
  12. The device of insulating coatings.
  13. The device of the roof.
  14. The device of bases, foundations of structures.

Certification of conformity of works: do you need it? Algorithm of actions

Mandatory certification of works in construction is provided by the Technical Regulations of the Republic of Belarus "Buildings and structures, building materials and products. Security" (TR 2009/013/BY), which was approved by Resolution of the Council of Ministers of the Republic of Belarus No. 1748 dated 31.12.2009.

Therefore,

Step 1.

We are looking for your works in the List approved by Resolution No. 1748, which will lead above.

If they are not there, your work is not subject to certification.

If they are there, we look at Step 2 additionally.

Step 2.

Not subject to mandatory certification:

1) construction works performed during the current repair of buildings and structures;

  A.1 Main types of work for foundations and walls of basements:

  1) sealing and stitching of joints, seams, cracks; restoration of individual places of wall cladding from basements, plinths;

  2) repair of basement entrances, windows, pits;

  3) restoration of individual sections of waterproofing of basement walls;

  4) punching (sealing) holes, sockets, furrows;

  5) device (sealing) ventilation ducts, pipes;

  6) replacement of individual sections of the blind area around the perimeter of the building, structures;

  7) sealing of entrances to basements and technical underground;

  8) installation of beacons on walls for monitoring deformations.

  A.2 Main types of work for walls:

  1) sealing of cracks, expansion of seams, restoration of lining of individual sections with an area of up to 2 m2;

  2) sealing of joints of elements of fully assembled buildings and sealing of potholes and cracks on the surface of blocks and panels;

  3) punching (sealing) holes, sockets, furrows;

  4) change of individual crowns, frame elements, reinforcement, insulation, caulking of grooves, change of sections of the cladding of wooden walls;

  5) laying openings in the walls;

  6) formulation for the solution of individual fallen stones;

  7) winterization frozen sections of walls (eliminating damp and problemati) in some areas (in the riser or in the same level) with the development of project documentation and coordination with its local Executive and administrative bodies in the field of architectural activities;

  8) cleaning and repair of ventilation ducts and exhaust devices.

  A.3 Main types of work for floors:

  1) temporary fixing of floors;

  2) partial replacement or reinforcement of individual elements of wooden floors (sections of inter-girder fillings, plank sheathing, individual beams); restoration of backfill and lubrication; antisepting and fire protection of wood;

  3) sealing of seams in the joints of precast reinforced concrete floors;

  4) sealing of potholes and cracks in reinforced concrete structures;

  5) insulation of the upper shelves of steel beams and their painting;

  6) insulation in certain areas of attic floors.

  A.4 Main types of work for roofs:

  1) replacement of individual beds, mauerlats and crates;

  2) antiseptic and fire protection of wooden structures;

  3) all types of work to eliminate minor roof malfunctions;

  4) strengthening and partial replacement of drainage pipes and coating of small architectural elements of the facade;

  5) repairs (partial replacement up to 40 %) of individual sections of the roofs or coverings of roofs, including the nodes adjacent to vertical surfaces;

  6) partial replacement of parapet slabs, fire escapes, ladders, cartridges, fences, roofs, devices grounds, anchors, antennas for radio and television antennas;

  7) installation or restoration of a protective layer of rolled and mastic roofs;

  8) restoration of waterproofing of individual roof elements;

  9) replacement or repair of roof exits, dormer windows and special hatches.

  A.5 Main types of work for window and door fillings, translucent structures:

  1) replacement of doorway fillings; restoration of individual elements of window, stained glass and showcase fillings; partial replacement (no more than 40%) of window fillings in the building

  and stained glass openings with their wear of 60% or more;

  2) installation of devices for self-closing doors, springs, stops;

  3) replacement of window and door devices;

  4) replacement of broken glass, glass blocks;

  5) insertion of window panes and opening transoms;

  6) installation of fire doors and hatches.

  A.6 Main types of work for partitions:

  1) strengthening, strengthening, replacement of individual sections of wooden partitions;

  2) sealing of cracks in plate partitions, re-laying of individual sections;

  3) improvement of sound insulation properties of partitions (sealing of interfaces with adjacent structures and other works).

  A.7 Main types of work for stairs, balconies, porches, umbrellas, canopies over entrances

  in the entrances and balconies of the upper floors:

  1) sealing of potholes, cracks of steps and platforms;

  2) replacement of individual steps, treads, risers;

  3) repair of balcony slabs (sealing potholes, cracks), replacement and strengthening of metal railings, balcony grilles, balcony screens and loggias;

  4) partial replacement of elements of wooden stairs;

  5) partial or complete replacement of handrails of stair and balcony railings;

  6) repair of entrances to the building.

  A.8 Main types of work for floors:

  1) replacement or repair of the floor covering in separate rooms without changing the design;

  2) replacement (device) of waterproofing of floors in separate sanitary units with a complete change of coating;

  3) sealing of potholes, cracks in cement, concrete, asphalt floors and foundations under floors;

  4) consolidation of plank floors;

  5) elimination of subsidence of the first floor floor on the ground.

  A.9 Main types of work for furnaces:

  1) all types of work to eliminate malfunctions of furnaces and chimneys, rearranging them in separate apartments;

  2) rearrangement of individual sections of pipes, hogs.

  A.10 Main types of work for interior decoration:

  1) restoration of plaster and cladding of walls and ceilings, including suspended ones in separate places;

  2) leveling of walls and ceilings with the use of sheet and mouldings;

  3) restoration and strengthening of stucco decorative details;

  4) all types of painting works;

  5) bringing the walls and ceilings on the evacuation routes into compliance with the requirements of the TNPA.

  A.11 Main types of work for exterior decoration:

  1) sandblasting, washing, painting of facade sections;

  2) restoration of plaster and cladding sections;

  3) strengthening or removal of architectural details threatening to fall, facing tiles, individual bricks from the facade; restoration of stucco details;

  4) exterior painting of windows, doors, balcony railings, parapet grilles, drainpipes, pergolas, plinths;

  5) restoration of house signs, full houses;

  6) repair of facades, improvement of architectural expressiveness of facades.

  A.12 Main types of work for heating:

  1) change of individual sections of pipelines, sections of heating devices, separate non-removable heating devices (plate, etc.), shut-off and control valves, mud pumps, elevator units;

  2) installation (if necessary) of air cranes;

  3) insulation of pipes, appliances, expansion tanks;

  4) laying of the lining of boilers, blast channels, chimney hogs (in the boiler room);

  5) change of individual sections for cast-iron boilers, fittings, control and measuring devices, grates;

  6) replacement of electric motors or low-power pumps;

  7) restoration of partially destroyed thermal insulation;

  8) hydraulic testing and flushing of the system;

  9) flushing of individual heating devices of the indoor riser;

  10) adjustment and adjustment of heating systems;

  11) installation and replacement of metering devices and regulation of thermal energy during the local performance of these works.

  A.13 Main types of work for ventilation:

  1) change of individual sections and elimination of leaks of ventilation boxes, shafts, chambers, air ducts;

  2) repair and replacement of fans, air valves and other equipment;

  3) repair, replacement, installation of deflectors, pipe heads;

  4) repair and adjustment of automatic fire extinguishing, smoke removal, alarm systems.

  A.14 Main types of works for water supply, sewerage, hot water supply (in-house systems):

  1) sealing of connections, elimination of leaks, insulation, strengthening of pipelines, replacement of individual sections of pipelines, fittings, siphons, ladders, revisions; restoration of destroyed thermal insulation of pipelines, hydraulic testing of the system (risers), elimination of blockages, cleaning of yard sewerage, drainage;

  2) replacement of individual worn-out water taps, shower faucets, shut-off valves, sanitary appliances and equipment (washbasins, toilets, etc.) in public buildings;

  3) insulation and replacement of fittings for water tanks in attics;

  4) replacement of individual sections and extension of external water outlets for watering courtyards and streets;

  5) replacement of fire cranes;

  6) repair and replacement of pumps and low-power electric motors;

  7) replacement of individual units or water heaters for baths, strengthening and replacement of flue pipes; cleaning of water heaters and coils from scale and deposits;

  8) sewer cleaning;

  9) anti-corrosion coating, marking;

  10) repair or replacement of control valves, control and measuring devices;

  11) flushing of water supply and sewerage systems;

  12) installation and replacement of devices for group and apartment-by-apartment accounting of cold and hot water supply during local performance of these works.

  A.15 Main types of work for electrical and low-current devices:

  1) replacement of faulty sections of the building's electrical network;

  2) replacement of failed switches, plugs, sockets and other devices (except residential premises);

  3) replacement of lamps, as well as protective lights and festive illuminations;

  4) replacement of fuses, auto-motor switches, batch switches of input and distribution devices, shields;

  5) replacement of electric motors and individual components of electrical installations of technical devices;

  6) ensuring electrical safety of electric stoves;

  7) elimination of failures of elevators and dispatch control systems for their operation;

  8) replacement or installation of automotive systems for monitoring the operation of central heating of in-house communication and alarm networks, control and measuring devices;

  9) connection of technical devices of buildings to the joint dispatching service, district dispatching service;

  10) repair of electrical protection devices for metal pipes of indoor central heating and water supply systems from corrosion;

  11) repair of radio, television and telephony networks;

  12) restoration of grounding circuits;

  13) replacement of failed sensors, wiring and fire and security alarm equipment.

  A.16 Main types of work for external landscaping:

  1) repair of sections of sidewalks, driveways, paths and platforms;

  2) restoration of damaged green spaces, lawns;

  3) repair, strengthening, replacement of individual sections of fences and equipment for children's playgrounds, sports and household playgrounds, yard latrines, garbage bins, playgrounds and canopies for garbage collection containers;

  4) installation and repair of benches installed on house territories;

  5) installation or replacement of blind spots, installation of ramps on porches of entrances to buildings.

  A.17 Other works:

  1) strengthening and installation of metal grilles protecting the windows of premises;

  2) restoration and installation of new passages in the attic through central heating pipes, ventilation ducts;

  3) replacement or strengthening of the gates of garbage chutes and garbage collection hatches, installation of devices for cleaning trunks;

  4) adjustment of all types of in-house equipment.

2) construction works performed on objects of the fifth class of complexity;

  5.5.1. Single-family residential buildings up to 7 m high.

  5.5.2. Temporary buildings and structures.

  5.5.3. Seasonal and auxiliary structures, canopies, fences, etc.

  5.5.4. Pavilions, kiosks for commercial and auxiliary purposes of complete factory production with an area of up to 50 sq.m.

  5.5.5. Mobile (inventory) buildings or structures.

  5.5.6. Garden houses, outbuildings on household, garden and country plots.

  5.5.7. Temporary power supply and communication lines, including poles of power transmission lines, communications and outdoor lighting.

  5.5.8. Detached buildings and structures for auxiliary and auxiliary purposes of agricultural agro-industrial complexes.

  5.5.9. Structures intended for outdoor advertising.

  5.5.10. Buildings of single-storey above-ground parking garages of box type without a basement, with exits directly outside, with a capacity of up to 100 cars.

  5.5.11. Parking structures with a capacity of up to 100 cars.

  5.5.12. Buildings and structures of warehouses without sorting and packaging processes with an area of up to 200 sq.m..

  5.5.13. Buildings and structures of agroecotourism objects of the 1st and 2nd categories according to TCP45-3.02-191 "Buildings and premises of recreation and tourism organizations. Design rules".

  5.5.14. Temporary and seasonal roads.

  5.5.15. Buildings and structures that, according to their technical characteristics, cannot be classified as complexity class K-4.

3) construction services provided by business entities, including individual entrepreneurs, on individual orders of individuals.

If your works fall under at least one of the above points, certification is optional for them.

3. Certificate of conformity for construction works

According to paragraph 1.11 of paragraph 1 of the Decree of the President of the Republic of Belarus No. 26 dated 14.01.2014. "On measures to improve construction activities" certain types of architectural, urban planning, construction activities (their components) according to the List approved by the Council of Ministers of the Republic of Belarus, as well as work on the inspection of buildings and structures are carried out by legal entities (individual entrepreneurs) in the presence of certificates of conformity issued in accordance with the Regulations on certification in the field of construction legal entities and individual entrepreneurs engaged in certain types of architectural, urban planning, construction activities (their components), performance of works on the inspection of buildings and structures (approved Resolution of the Council of Ministers of the Republic of Belarus No. 252 dated 21.03.2014).

The implementation of types of architectural, urban planning, construction activities (their components), the performance of works on the inspection of buildings and structures without a certificate of conformity, when its presence is mandatory, is prohibited.

  5) insulation of the upper shelves of steel beams and their painting;

  6) insulation in certain areas of attic floors.

  A.4 Main types of work for roofs:

  1) replacement of individual beds, mauerlats and crates;

  2) antiseptic and fire protection of wooden structures;

  3) all types of work to eliminate minor roof malfunctions;

  4) strengthening and partial replacement of downpipes and coatings of small architectural elements on the facade;

  5) repair (partial replacement, no more than 40%) of individual sections of roofs or roof coverings, including nodes adjacent to vertical surfaces;

  6) partial replacement of parapet plates, fire ladders, ladders, sleeves, roof fences, grounding devices, anchors, antennas for radio and television antennas;

  7) installation or restoration of a protective layer of rolled and mastic roofs;

  8) restoration of waterproofing of individual roof elements;

  9) replacement or repair of roof exits, dormer windows and special hatches.

  A.5 Main types of work for window and door fillings, translucent structures:

  1) replacement of doorway fillings; restoration of individual elements of window, stained glass and showcase fillings; partial replacement (no more than 40%) of window fillings in the building

  and stained glass openings with their wear of 60% or more;

  2) installation of devices for self-closing doors, springs, stops;

  3) replacement of window and door devices;

  4) replacement of broken glass, glass blocks;

  5) insertion of window panes and opening transoms;

  6) installation of fire doors and hatches.

  A.6 Main types of work for partitions:

  1) strengthening, strengthening, replacement of individual sections of wooden partitions;

  3) sealing of potholes, cracks in cement, concrete, asphalt floors and foundations under floors;

  4) consolidation of plank floors;

  5) elimination of subsidence of the first floor floor on the ground.

  A.9 Main types of work for furnaces:

  1) all types of work to eliminate malfunctions of furnaces and chimneys, rearranging them in separate apartments;

  2) rearrangement of individual sections of pipes, hogs.

  A.10 Main types of work for interior decoration:

  1) restoration of plaster and cladding of walls and ceilings, including suspended ones in separate places;

  2) leveling of walls and ceilings with the use of sheet and mouldings;

  3) restoration and strengthening of stucco decorative details;

  4) all types of painting works;

  5) bringing the walls and ceilings on the evacuation routes in compliance with the requirements of the TNPA.

  A.11 Main types of work for exterior decoration:

  1) sandblasting, washing, painting of facade sections;

  2) restoration of plaster and cladding sections;

  3) strengthening or removal from the facade of architectural details threatening to fall, facing tiles, individual bricks; restoration of stucco details;

  4) exterior painting of windows, doors, balcony railings, parapet grilles, downpipes, pergolas, plinth;

  5) restoration of house signs, full houses;

  6) repair of facades, improvement of architectural expressiveness of facades.

  A.12 Main types of work for heating:

  1) change of individual sections of pipelines, sections of heating devices, separate non-removable heating devices (plate, etc.), shut-off and control valves, mud pumps, elevator units;

  2) installation (if necessary) of air cranes;

  3) insulation of pipes, appliances, expansion tanks;

  4) rearrangement of the lining of boilers, blast ducts, chimney hogs (in the boiler room);

  5) change of individual sections of cast-iron boilers, fittings, instrumentation, grates;

  6) replacement of electric motors or low-power pumps;

  7) restoration of partially destroyed thermal insulation;

  8) hydraulic testing and flushing of the system;

  9) flushing of individual heating devices of the indoor riser;

  10) adjustment and adjustment of heating systems;

  11) installation and replacement of metering devices and regulation of thermal energy during the local performance of these works.

  A.13 Main types of work for ventilation:

  1) sealing of connections, elimination of leaks, insulation, strengthening of pipelines, replacement of individual sections of pipelines, fittings, siphons, ladders, revisions; restoration of destroyed thermal insulation of pipelines, hydraulic testing of the system (risers), elimination of blockages, cleaning of yard sewerage, drainage;

  2) replacement of individual worn-out water taps, shower faucets, shut-off valves, sanitary appliances and equipment (washbasins, toilets, etc.) in public buildings;

  3) insulation and replacement of fittings for water tanks in attics;

  4) replacement of individual sections and extension of external water outlets for watering courtyards and streets;

  5) replacement of fire cranes;

  6) repair and replacement of pumps and low-power electric motors;

  7) replacement of individual units or water heaters for baths, strengthening and replacement of flue pipes; cleaning of water heaters and coils from scale and deposits;

  8) sewer cleaning;

  9) anti-corrosion coating, marking;

  10) repair or replacement of control valves, control and measuring devices;

  11) flushing of water supply and sewerage systems;

  12) installation and replacement of devices for group and apartment-by-apartment accounting of cold and hot water supply during local performance of these works.

  A.15 Main types of work for electrical and low-current devices:

  1) replacement of faulty sections of the building's electrical network;

  2) replacement of failed switches, plugs, sockets and other devices (except residential premises);

  3) replacement of lamps, as well as protective lights and festive illuminations;

  4) replacement of fuses, auto-motor switches, batch switches of input and distribution devices, shields;

  5) replacement of electric motors and individual components of electrical installations of technical devices;

  6) ensuring electrical safety of electric stoves;

  7) elimination of failures of elevators and dispatch control systems for their operation;

  8) replacement or installation of automotive systems for monitoring the operation of central heating of in-house communication and alarm networks, control and measuring devices;

  9) connection of technical devices of buildings to the joint dispatching service, district dispatching service;

  10) repair of electrical protection devices for metal pipes of indoor central heating and water supply systems from corrosion;

  11) repair of radio, television and telephony networks;

  12) restoration of grounding circuits;

  13) replacement of failed sensors, wiring and fire and security alarm equipment.

  A.16 Main types of work for external landscaping:

  1) repair of sections of sidewalks, driveways, paths and platforms;

  2) restoration of damaged green spaces, lawns;

  3) repair, strengthening, replacement of individual sections of fences and equipment for children's playgrounds, sports and household playgrounds, yard latrines, garbage bins, playgrounds and canopies for garbage collection containers;

  4) installation and repair of benches installed on house territories;

  5) installation or replacement of blind spots, installation of ramps on porches of entrances to buildings.

  A.17 Other works:

  1) strengthening and installation of metal grilles protecting the windows of premises;

  2) restoration and installation of new passages in the attic through central heating pipes, ventilation ducts;

  3) replacement or strengthening of the gates of garbage chutes and garbage collection hatches, installation of devices for cleaning trunks;

  4) adjustment of all types of in-house equipment.

4. Certified specialists in the state

The presence of certified specialists is necessary for the certification of construction works and evaluation of the production control system.

Specialists pass the exam in accordance with the procedure provided for by the Regulations on Certification of in Construction managers, specialists of organizations and individual entrepreneurs engaged in activities in the field of architectural, urban planning, construction activities, performance of works on the inspection of buildings and structures (approved by Resolution of the Council of Ministers of the Republic of Belarus No. 252 dated 21.03.2014).

According to the results of the certification of specialists in construction qualification certificates are issued.

The list of managers, specialists of organizations and individual entrepreneurs who are subject to certification, carrying out activities in the field of architectural, urban planning, construction activities, performing works on the inspection of buildings and structures, the criteria for their admission to certification in its specializations was approved by Resolution No. 15 of the Ministry of Architecture and Construction of the Republic of Belarus dated 26.03.2014.

5. Production control system

It is necessary for certification of works, as well as for obtaining a certificate of conformity by a legal entity or individual entrepreneur.

SEC is being evaluated in accordance with TCP 45-1.01-221-2010 (02250) "Construction. Evaluation of the production control system. The main provisions and the procedure for conducting".

6. Occupational Health and Safety Management System (OSS)

According to Article 17 of the Law of the Republic of Belarus dated 23.07.2008 N 356-Z "On Labor Protection" and paragraph 8 of Article 226 of the Labor Code of the Republic of Belarus, the employer must develop, implement and maintain the functioning of a labor protection management system that ensures the identification of hazards, assessment of occupational risks, definition of occupational risk management measures and analysis of their effectiveness.

The management system is being developed and implemented in accordance with STB 18001-2009 "Occupational health and Safety management systems. Requirements".

Construction contract for legal entities

We present to you for filling out and downloading a sample construction contract agreement, with appendices to it: construction work schedule, payment schedule, material resources delivery schedule.

According to the construction contract (hereinafter referred to as the contract), the contractor undertakes to build a certain object on the customer's instructions or to perform construction and other special installation works and hand them over to the customer within the time specified in the contract, and the customer undertakes to create the necessary conditions for the contractor to perform the work, accept the results of these works and pay the stipulated price.

Our contract provides for conditions that are most often agreed upon in practice between the parties. This applies to the terms of payment, the procedure for termination of the contract and the liability of the parties.

The contract is concluded subject to the availability of the customer:

• permits for the design, construction, reconstruction, restoration, overhaul of the facility, issued by the local executive and administrative body in accordance with the established procedure (except for facilities for the construction of which, in accordance with the legislation, obtaining permits is not required or the contract provides for the construction of a turnkey facility);
• extracts from the registration book on the rights, restrictions (encumbrances) of rights to the land plot on which construction will be carried out, issued no earlier than 30 days before the date of conclusion of the contract;
• project documentation for the construction, reconstruction, restoration, major repairs, landscaping of the object, which has passed state expertise in the cases and in the manner prescribed by law, and approved in accordance with the established procedure (hereinafter referred to as project documentation), if the obligation to provide project documentation is not imposed by the contract on the contractor;
• protocol on the results of the contract bidding and the selection of their winner, if the contract bidding is mandatory;
• documents confirming the right to carry out architectural, urban planning and construction activities, in cases provided for by law.

And subject to the contractor's availability:

1. documents confirming the right to carry out architectural, urban planning and construction activities, in cases provided for by law;
2. for the construction of buildings and structures of the I and II levels of responsibility, as well as for carrying out major repairs, reconstruction, restoration, landscaping at these facilities, the right to carry out architectural, urban planning and construction activities is confirmed by the certificates of conformity of construction works available to the contractor (contractor, subcontractor) and documents certifying the existence of a production control system;
3. in the staff of certified specialists.
4. reservation of funds on a special account in the amount of 1.5% of the cost of construction, special, installation works performed at the facility;
5. bank guarantee;
6. liability insurance under a construction contract for non-fulfillment or improper fulfillment of such obligations.

There is a separate contract for current repairs or finishing works:

• Estimate for construction materials
• Certificate of acceptance of repair and finishing works

The contract is suitable for repair and finishing works, the customer can be legal entities, individual entrepreneurs and individuals. Contractors can only be individual entrepreneurs and legal entities.
